Public offerPlease read the user agreement before purchasing goods in our online store «surat.com.ua».This text is a user agreement between the online store «surat.com.ua», hereinafter referred to as the «Online Store», and the user of the Online Store’s services, hereinafter referred to as the «Buyer», and defines the terms of purchasing goods through the Online Store’s website.1. General provisions1.1. This Agreement is concluded between the Buyer and the Online Store at the moment the order is placed.1.2. The information posted on the Online Store’s website contains the terms of the offer to purchase goods and is a public offer, the status of which is established by Art. 633 of the Civil Code of Ukraine. Acceptance is the fact of placing an order for the offered goods.1.3. When placing an order, the Buyer agrees to the terms set out in this Agreement by ticking the box «I have read and agree to the terms of the Agreement» when placing the order.1.4. Any individual or legal entity able to accept and pay for the goods may make a purchase in the Online Store.1.5. Goods are paid for in the national currency of Ukraine upon delivery or by non-cash bank transfer.2. Product information2.1. The goods are presented in the catalog through photo samples that are the property of the Online Store.2.2. Each photo sample is accompanied by text information: article number, price and product description.2.3. At the Buyer’s request, the Online Store manager is obliged to provide (by phone, via Viber or by email) additional information that, in the Buyer’s opinion, is necessary and sufficient to make a purchase decision.2.4. The price of goods indicated on the website may be changed by the Online Store unilaterally.2.5. If the price of goods ordered by the Buyer changes, the Online Store manager informs the Buyer at the earliest opportunity (by phone, via Viber or by email) to obtain confirmation or cancellation of the order. If it is impossible to contact the Buyer, the order is considered cancelled.3. Procedure for purchasing goods in the online store3.1. Orders are accepted through the Online Store and its official social media pages.3.2. The Buyer has the right to place an order for any product presented on the Online Store’s website and available in stock. Each product may be ordered in any quantity. The Buyer may place an order in the following ways: by phone, by email, via Viber or independently on the website.3.3. If the product is out of stock, the company manager is obliged to notify the Buyer (by phone, via Viber or by email).3.4. If the product is unavailable, the Buyer has the right to replace it with a product of a similar model, refuse this product, or cancel the order.3.5. The Buyer has the right to cancel the order at any time before it is shipped by notifying the Online Store by phone, via Viber or by email.4. Delivery and transfer of goods to the Buyer4.1. Goods purchased in the Online Store are delivered by the «Nova Poshta» delivery service (Nova Poshta LLC (EDRPOU 31316718)) and by the Online Store’s courier service.4.2 The ordered goods are shipped within 3 business days from the date the Buyer confirms the order. Sundays and official public holidays are not business days.4.3. Together with the order, the Buyer receives the following documents: a waybill (issued by the courier service upon delivery), a sales receipt or invoice (at the Buyer’s request).4.4. At the order pick-up point (a «Nova Poshta» branch) or in the presence of the courier (for address delivery), the Buyer is obliged to check the ordered goods for quantity, quality, assortment and completeness.4.5. The fact of acceptance of the goods by the Buyer is the payment for the goods by the Buyer at the order pick-up point (a «Nova Poshta» branch) or in the presence of the courier (for address delivery)4.6. After the Buyer has accepted the goods, claims regarding the quantity, quality, assortment and completeness of the ordered goods are accepted in the manner prescribed by law.4.7. If the Buyer refuses the order at the time of delivery, the Buyer pays the Online Store’s costs of delivering the order.4.8. The Buyer is not obliged to compensate the Online Store’s delivery costs if, during acceptance, it turns out that goods of improper quality, quantity, assortment or completeness have been delivered.5. Payment for the order5.1. An order placed in the Online Store is paid for by the Buyer by bank transfer or in cash upon receipt of the order.5.2. Non-cash payment for the order must be made by the Buyer by 100% advance transfer of funds to the Online Store’s current account within two business days from the date of order confirmation.5.3. If the funds are not received, the Online Store reserves the right to cancel the order.6. Procedure for returning goods of proper quality6.1. The Buyer has the right to refuse the delivered goods before acceptance, at the moment of receipt from the courier or at the pick-up point.6.2. Goods may be returned to the Online Store if their presentation, consumer properties, original factory packaging and waybill have been preserved.6.3. Goods are returned to the Online Store at the Buyer’s expense.6.4. When the Buyer returns goods of proper quality, the Online Store refunds the amount paid for the goods upon their return, minus compensation for the store’s costs related to delivering the goods to the Buyer.6.5. The goods of the Online Store belong to the category of personal hygiene items, which are not subject to exchange or return under the legislation of Ukraine, in accordance with Resolution of the Cabinet of Ministers of Ukraine No. 172 of 19.03.94. However, the site administration always tries to please its customers and is ready to accommodate them in special cases.7. Personal data7.1. By placing an Order in the Online Store, the Buyer consents to the Online Store collecting and processing (accumulating, storing, adapting, updating, using, distributing, depersonalizing and destroying) the data provided by the Buyer, namely: surname, first name, patronymic, email, phone number, address, in order to ensure purchase and sale relations, relations in the field of consumer protection, advertising and marketing research, and also consents to the transfer (distribution) of their data to Nova Poshta LLC (EDRPOU 31316718), other freight forwarding and courier organizations, and other third parties (without limitation) at the discretion of the Online Store. This provision is valid without time limit.7.2. The source of personal data collection is information provided directly and voluntarily by the Buyer.7.3. The owner of the personal data provided by the Buyer is the Online Store.7.4 In accordance with the Law of Ukraine «On Personal Data Protection», the personal data subject has the right to: know the sources of collection and the location of their personal data, the purpose of their processing, the location or place of residence (stay) of the owner or controller of personal data, or give the appropriate instruction to authorized persons to obtain this information, except in cases established by law; receive information about the conditions for granting access to personal data, in particular information about third parties to whom their personal data are transferred; access their personal data; receive, no later than thirty calendar days from the date of receipt of the request, except in cases provided for by law, a response as to whether their personal data are being processed, as well as receive the content of such personal data; submit a reasoned request to the owner of personal data objecting to the processing of their personal data; submit a reasoned request to change or destroy their personal data by any owner and controller of personal data if these data are processed unlawfully or are inaccurate; protect their personal data from unlawful processing and accidental loss, destruction or damage due to deliberate concealment, non-provision or untimely provision, as well as protection from the provision of information that is inaccurate or discredits the honor, dignity and business reputation of an individual; file complaints about the processing of their personal data with the Commissioner or the court; apply legal remedies in case of violation of personal data protection legislation; make reservations regarding the restriction of the right to process their personal data when giving consent; withdraw consent to the processing of personal data; know the mechanism of automatic processing of personal data; be protected from an automated decision that has legal consequences for them.8. Other8.1. The Online Store reserves the right to expand and reduce the product offering on the Website, regulate access to the purchase of any goods, and suspend or terminate the sale of any goods at its own discretion.8.2. This Agreement shall be considered as published on the Website and shall be applied and interpreted in accordance with the legislation of Ukraine.
